Original action -- . Petition denied. On February 15, 1946, Harry Doxtater filed a petition in this Court, requesting that an order to show cause be issued requiring L. F. Murphy, Warden of the Wisconsin State Prison, to show cause why a writ of should not issue, in accordance with the procedure outlined in Re Exercise of Original Jurisdiction, 1930, 201 Wis. 123, 124, 229 N.W. 643. The petitioner alleged that his imprisonment in the state prison at Waupun was unlawful for the reason that the petitioner was sentenced and committed to the state prison upon his plea of guilty of an assault with intent to commit the crime of rape; that without the advice of counsel he plead guilty thereto and by reason of the courts failure to provide him with counsel he was denied due process of law. The petition itself was insufficient but there was filed with it a certified copy of the proceedings had in the municipal court. Supplementing the allegations of the petition by reference to the certified copy of the proceedings in municipal court, the following facts appear: On September 6, 1945, the petitioner was arrested on a complaint, charging him with having assaulted one Anna Chambers with intent to commit the crime of rape. A warrant was issued, the petitioner was brought into court on the 6th day of September, 1945. The complaint was read to the petitioner by the court. Thereupon the following colloquy took place between the petitioner and the court:
