1 This appeal arises in an action in the District Court of Oklahoma County in which the defendant in error, Hal B. McKnight, an individual doing business as McKnight Construction Company, as plaintiff, sought a money judgment against LeFlore County, Oklahoma (properly designated therein, pursuant to 19 O.S. 1961 ? 4 , as the Board of County Commissioners of LeFlore County, Oklahoma), J. Paul Mathies, identified therein as a member of the board of county commissioners of that county, and Rex Collins and Harold F. Flood (an engineering partnership doing business as Collins & Flood), who resided in and were served with summons in Pittsburg County, Oklahoma. The money judgment sought against them was for damages allegedly resulting from acts of omission and commission in connection with the performance of two highway construction contracts by the plaintiff.
