This action was commenced on April 20, 1956. It involves a petition of the plaintiff, City of West Allis, for a writ of certiorari directing the defendants Herman C. Dieringer, Village Clerk, Village of West Milwaukee and George L. Luck, Town Clerk, Town of Greenfield to certify to the court all records and files of proceedings relating to Order made by the Village Board of the Village of West Milwaukee and the Town Board of the Town of Greenfield, acting jointly, at a hearing and meeting held March 13, 1956, and which Order pertained to the creation of Joint School District No. 16, of the Village of West Milwaukee and the Town of Greenfield. By the petition, the plaintiff sought a review and determination of the validity of the Order. Issue was joined by the defendants return to the petition. In the court below this action was consolidated for trial with two other actions entitled State ex rel. City of West Allis, a municipal corporation, Appellant, v. John J. Zawerschnik et al. as Clerk etc. of School District No. 12, Village of West Milwaukee, Respondents, and City of West Allis, a municipal corporation, Appellant, v. Village of West Milwaukee, et al., Respondents. Judgments were rendered on August 6, 1956 in favor of the defendants in each of the actions. Appeals were taken from the judgments and the cases were argued together in this court. The other cases are considered and reported in opinions separately filed as of this date.
